Babu Owino Rejects DCI Summons Over Kakamega Linda Mwananchi Rally

Embakasi East MP Babu Owino has challenged a summons issued by the Directorate of Criminal Investigations (DCI) regarding the Kakamega Linda Mwananchi rally, claiming the investigation is politically motivated.

In a letter to the Western Region DCI Regional Director on March 17, Babu stated that junior officers were dispatched to summon him to Kakamega for questioning over the rally held at Amalemba grounds and Mbale. 

He questioned whether the regional director was acting under pressure from higher authorities.

“While I appreciate the kind of pressure you are going through from your superiors, I advise that your focus should be on preserving the oath of office you took, which binds you to the rule of law,” Babu wrote.

Kakamega Venue Deemed Intimidation

Babu criticized the choice of Kakamega as the venue for questioning, calling it an intimidation tactic. He insisted that any legal proceedings should occur in Nairobi, citing the absence of a specialized court in Kakamega for such matters.

Reference to Court Ruling and Cybercrime Law
The MP also cited the Court of Appeal ruling in Civil Appeal No. 197 of 2020, urging the DCI to consider its implications on the application of the Computer Misuse and Cyber Crimes Act 2018 in political contexts.

“I advise you to break down the Court of Appeal judgement and explain its jurisprudential impact on the use of the said Act to pursue and contain progressive forces within a suffocated democracy,” he stated.

Babu reminded law enforcement officials of their duty to exercise independence and uphold public trust.

Political Ambitions Amid Rising Tensions

This development comes over two months after Babu warned his constituents about alleged plots to end his political career following his declaration to vie for ODM party leadership. 

He also reiterated his interest in the Nairobi County Governorship while maintaining his long-term goal of becoming President.

“After the county, God will take us to the State House because you are my family, and wherever you go, I will go,” he assured supporters.

The episode highlights rising tension between politicians and law enforcement agencies as Kenya approaches the 2027 elections.
